A Deeply Defective Public Character

We have as president a man who routinely slanders his political opponents, distorting what they believe, even as he bemoans the lack of civility in public discourse. He constantly makes assertions that are obviously untrue. And it doesn’t matter to him. He keeps doing it because, at least until now, the media has given him something approaching a free pass.

I have no idea if Mr. Obama was born mendacious or whether he learned the habit somewhere along the way. What I do know is that Barack Obama is thoroughly post-modern. Words and facts have no objective standing with him; they are socially constructed, unmoored, infinitely malleable, a way to create his own reality and advance his own self-interest.

Mr. Obama clearly believes that because his agenda is right and noble and his opponents are benighted and evil, he has license to say pretty much whatever he wants pretty much whenever he wants. After all, anything that advances his agenda while rebuffing the (choose your descriptor) nihilistic, anarchistic, heartless, ruthless, Taliban-like Republicans is allowable. Even encouraged. It’s the Chicago Way.

Mr. Obama, then, has a deeply defective public character. He simply makes things up as he goes along. He invents his own reality. And the fact that he is inflicting significant and durable harm to our political culture, and to America itself, seems to bother him not one bit.

There is something quite disturbing about this president’s capacity to mislead people with such ease and with such relish. He’s not a man who can be trusted with power.

Fraud

We now see why Obama and the Democrats, who passed ObamaCare in 2010, did not implement it until after the 2012 election.

President Obama repeatedly assured Americans that after the Affordable Care Act became law, people who liked their health insurance would be able to keep it. But millions of Americans are getting or are about to get cancellation letters for their health insurance under Obamacare, say experts, and the Obama administration has known that for at least three years.

Four sources deeply involved in the Affordable Care Act tell NBC NEWS that 50 to 75 percent of the 14 million consumers who buy their insurance individually can expect to receive a “cancellation” letter or the equivalent over the next year because their existing policies don’t meet the standards mandated by the new health care law. One expert predicts that number could reach as high as 80 percent. And all say that many of those forced to buy pricier new policies will experience “sticker shock.”

None of this should come as a shock to the Obama administration. The law states that policies in effect as of March 23, 2010 will be “grandfathered,” meaning consumers can keep those policies even though they don’t meet requirements of the new health care law. But the Department of Health and Human Services then wrote regulations that narrowed that provision, by saying that if any part of a policy was significantly changed since that date — the deductible, co-pay, or benefits, for example — the policy would not be grandfathered.

Buried in Obamacare regulations from July 2010 is an estimate that because of normal turnover in the individual insurance market, “40 to 67 percent” of customers will not be able to keep their policy. And because many policies will have been changed since the key date, “the percentage of individual market policies losing grandfather status in a given year exceeds the 40 to 67 percent range.”

That means the administration knew that more than 40 to 67 percent of those in the individual market would not be able to keep their plans, even if they liked them.

A Rude Awakening

For all of the Affordable Care Act’s technical problems, at least one part is working on schedule. The law is systematically dismantling the individual insurance market, as its architects intended from the start.

The millions of Americans who are receiving termination notices because their current coverage does not conform to Health and Human Services Department rules may not realize this is by design. Maybe they trusted President Obama’s repeated falsehood that people who liked their health plans could keep them. But Americans should understand that this month’s mass cancellation wave has been the President’s political goal since 2008. Liberals believe they must destroy the market in order to save it.

None of this is an accident. It is the deliberate result of the liberal demand that everyone have essentially the same coverage and that government must dictate what that coverage is and how much it costs. Such political control is the central nervous system of the Affordable Care Act, and it is why so many people can’t keep the insurance they like.

It’s an unexpected reality of Obamacare being told through anecdotes in local papers and on social media. But the hard numbers reveal the evidence is far more than anecdotal. CBS News has confirmed with insurance companies across the country that more than two million people are getting notices they no longer can keep their existing plans. In California, there are 279,000; in Michigan, 140,000; Florida, 300,000; and in New Jersey, 800,000. And those numbers are certain to go even higher. Some companies who tell CBS News they’ve sent letters won’t say how many.

No major legislation has ever been passed like Obamacare — and I’m using the word “passed” pretty loosely.

It became law without both houses ever voting on the same bill. (Say, is the Constitution considered “settled law”?) Not one Republican voted for it — and a lot of Democrats immediately wished they hadn’t.

Historically, big laws have been enacted with large, bipartisan majorities. In 1935, President Roosevelt enacted Social Security with a 372-33 vote in the House and 77-6 in the Senate.

In 1965, Medicare passed in the Senate 70-24 and the House 307-116, with the vast majority of Democrats supporting this Ponzi scheme and Republicans roughly split.

Reagan’s magnificent tax cuts in 1981 — which Democrats now denounce as if they’d been appalled at the time — passed with a vote of 89-11 in the Senate and even 323-107 in the hostile Democratic House.

Even Bill Clinton’s signature legislative achievement — Midnight Basketball for the Homeless — received more bipartisan support than Obamacare.

No law, certainly not one that fundamentally alters the role of the government, has ever been passed like this.

The Government “Shutdown”

Nine days into the partial government shutdown, the operative word is partial. The best estimates are that about 83% of government outlays are still flowing, including to the military, Social Security, Medicare, airport screeners and the Postal Service. As for the rest, one benefit of the shutdown is that it has reminded the country that it can function well without the dozens of federal bodies that exist solely to layer more burdens on the private economy.

Consider the evidence in the Federal Register, which is the record of new government rules that Washington is imposing on the rest of us. Here are the number of pages published on certain recent days in the Register: 498 pages on September 11, 193 on September 17, 369 on September 20, and 401 on September 30. But after the shutdown, the number falls to 12 pages on October 7 and all of six on October 9. And yet our glorious Republic still stands.

The 401 pages on September 30 included such proud bureaucratic work as: a proposed Agricultural Marketing Service rule to increase assessment rates for blueberry promotion, a notice from the Federal Motor Carrier Safety Administration about exemptions for commercial vehicle operators with diabetes, and a proposal from the Fish and Wildlife Service to provide threatened status for the bird known as the rufa red knot. Maybe the shutdown is helping the economy.

Chaotic

Amid all the charges and countercharges in Washington over the government shutdown, there is at least one common theme: Barack Obama’s various charges always lead to a dead end. They are chaos, and chaos is hard to understand, much less refute.

By that I mean when the president takes up a line of argument against his opponents, it cannot really be taken seriously — not just because it is usually not factual, but also because it always contradicts positions that Obama himself has taken earlier or things he has previously asserted. Whom to believe — Obama 1.0, Obama 2.0, or Obama 3.0?

When the president derides the idea of shutting down the government over the debt ceiling, we almost automatically assume that he himself tried to do just that when as a senator he voted against the Bush administration request in 2006, when the debt was about $6 trillion less than it is now.

When the president blasts the Republicans for trying to subvert the “settled law” of Obamacare, we trust that Obama himself had earlier done precisely that when he unilaterally subverted his own legislation — by quite illegally discarding the employer mandate provision of Obamacare. At least the Republicans tried to revise elements of Obamacare through existing legislative protocols; the president preferred executive fiat to nullify a settled law.

When the president deplores the lack of bipartisanship and the lockstep Republican effort to defund Obamacare, we remember that the president steamrolled the legislation through the Congress without a single Republican vote.

When the president laments the loss of civility and reminds the public that he uses “calm” rhetoric during the impasse, we know he has accused his opponents of being on an “ideological crusade” and of being hostage takers and blackmailers who have “a gun held to the head of the American people,” while his top media adviser Dan Pfeiffer has said that they had “a bomb strapped to their chest.”

When the president insists that the Republican effort to hold up the budget is unprecedented, we automatically deduce that, in fact, the action has many precedents, and on frequent prior occasions was a favored ploy of Democrats to gain leverage over Republican administrations.

In short, whenever the president prefaces a sweeping statement with one of his many emphatics — “make no mistake about it,” “I’m not making this up,” “in point of fact,” “let me be perfectly clear” — we know that the reverse is always true. For Obama, how something is said matters far more than what is said. If he stumbles, as is his wont, through an un-teleprompted remark that on rare occasions can be mostly accurate, that is a serious lapse; if, more frequently, he mellifluously asserts a teleprompted falsehood, there is little worry. The result is not so much untruth, lies, or distortions, as virtual chaos. Is what he says untrue, contradictory of what he said or did earlier, or just nonsensical?

These strange flights of fantasy are not new. When Barack Obama boasts that “American oil production is the highest that it’s been in eight years,” we know that is despite, not because of, his efforts, remembering that oil and gas leases have markedly decreased during the Obama administration, as they have soared on private and state lands. Again, how do you refute fantasy?

When he brags of the present chaos in the Middle East by saying that “a wave of change has washed across the Middle East and North Africa” during his administration, we translate that into 100,000 are dead in Syria and U.S. credibility about red lines is shredded; the Muslim Brotherhood coming to power in Egypt followed by a coup and rule by a junta; “leading from behind” in Libya resulting in a virtual Somalia well before the Benghazi disaster; abdication in Iraq, which is now less stable than it was in 2009; and Vietnam circa 1975 looming in Afghanistan.

When the president boasts that the deficit is actually shrinking under his leadership, we assume he is referring to the forced budget cuts brought about by sequestration that he not only opposed, but also warned would be disastrous.

These paradoxes could be interpreted in various ways. True, Obama is a politician who takes up and discards arguments as he finds them useful, always branding those currently in use as somehow morally superior to the alternative. Obama is also a zealot and a community organizer who is not content with opposing the positions of his opponents, but always must impugn their motives as well.

But a third explanation is more likely. Obama simply couldn’t care less about what he says at any given moment, whether it is weighing in on the football name “Redskins” or the Travyon Martin trial. He is detached and unconcerned about the history of an issue, about which he is usually poorly informed. Raising the debt ceiling is an abstraction; all that matters is that when he is president it is a good thing and when he is opposing a president it is a bad one. Let aides sort out the chaos. Obamacare will lower premiums, not affect existing medical plans, and not require increased taxes; that all of the above are untrue matters nothing. Who could sort out the chaos?

When other presidents act unilaterally, Obama cites his constitutional experience in demagoguing them, as he did against Bush during the crafting of the war on terror legislation. When he wishes either to violate the law or to adopt a prior Bush protocol, then he simply does so, and lets others sort out the inconsistency. Sometimes the result is so chaotic that Obama ends up bragging that he wants to shut down Guantanamo Bay, which he has kept open for five years, as if it was long ago virtually shut down. When we go into Libya, we do so instead of going into Syria because Libya is said to be a war and the violence in Syria a mere police action; when Libya turns out to be a disaster, then we will go into Syria.

During the present crisis, Obama simply asks his aides what are the arguments of the day to be made. When he is instructed that Republicans are doing something bad, something unprecedented, and something anarchic, then like his often referenced hero LeBron James, Obama wants the rhetoric ball to complete the demagogic play, which results in the usual chaotic invective. That the Republicans are doing something that is not unprecedented or anarchic, but similar to what Obama himself and his party have done in the past, is not even noticed.

In the mind of Obama there are many narratives. If something is a little better in the Middle East, but most things are a lot worse, then the little is his, and the most belongs to others. If somebody did not listen to Obama and decided to produce more gas and oil, then what difference does it make — given that at least they produced more gas and oil at the same time that he was in office?

If smaller deficits are deemed by most to be better than larger ones, then Obama agrees and who cares that he was indifferent whether they became bigger or smaller?

The media, of course, accepts that what Obama says on any given day will contradict what he has said or done earlier, or will be an exaggeration or caricature of his opponents’ position, or simply be detached from reality. But in their daily calculus, that resulting chaos is minor in comparison to the symbolic meaning of Obama. He is, after all, both the nation’s first African-American president and our first left-wing progressive since Franklin Roosevelt.

In comparison with those two facts, no others really matter.

The Republican Blind Spot

If the continued existence of mathematics depended on the ability of the Republicans to defend the proposition that two plus two equals four, it would probably mean the end of mathematics and of all the things that require mathematics.

The Republican speaker of the House of Representatives, John Boehner, epitomized what has been wrong with the Republicans for decades when he emerged from a White House meeting last Wednesday, went over to the assembled microphones, briefly expressed his disgust with the Democrats’ intransigence, and walked on away.

We are in the midst of a national crisis, immediately affecting millions of Americans and potentially affecting the kind of country this will become if Obamacare goes into effect — and yet, with multiple television-network cameras focused on Speaker Boehner as he emerged from the White House, he couldn’t be bothered to prepare a statement that would help clarify a confused situation, full of fallacies and lies.

Boehner is not unique in having a blind spot when it comes to recognizing the importance of articulation and the need to put some serious time and effort into presenting your case in a way that people outside the Beltway would understand. On the contrary, he has been all too typical of Republican leaders in recent decades.

When the government was shut down during the Clinton administration, Republican leaders who went on television to tell their side of the story talked about “OMB numbers” versus “CBO numbers” — as if most people beyond the Beltway knew what these abbreviations meant or why the statistics in question were relevant to the shutdown. Why talk to them in Beltway-speak?

When Speaker Boehner today goes around talking about the “CR,” that is just more of the same thinking — or lack of thinking. Policy wonks inside the Beltway know that he is talking about the continuing resolution that authorizes the existing level of government spending to continue, pending a new budget agreement.

But, believe it or not, there are lots of citizens and voters outside the Beltway. And what is believed by those people whom too many Republicans are talking past can decide not only the outcome of this crisis but the fate of the nation for generations to come.

You might think that the stakes are high enough for Republicans to put in some serious time trying to clarify their message. As the great economist Alfred Marshall once said, facts do not speak for themselves. If we are waiting for the Republicans to do the speaking, the country is in big trouble.

Democrats, by contrast, are all talk. They could sell refrigerators to Eskimos before Republicans could sell them blankets. Indeed, Democrats sold Barack Obama to the American public, which is an even more amazing feat, considering his complete lack of relevant experience and questionable (at best) loyalty to the values and institutions of this country. The Democrats have obviously given a lot of attention to articulation, including coordinated articulation among their members. Some years ago, Senator Chuck Schumer was recorded, apparently without his knowledge, telling fellow Democrats to keep using the word “extremist” when discussing Republicans. Even earlier, when George W. Bush first ran for president, the word that suddenly began appearing everywhere was “gravitas” — as in the endlessly repeated charge that Bush lacked “gravitas.” People who had never used that word before suddenly began using it all the time.

Today, the Democrats’ buzzword is “clean” — as in the endlessly repeated statement that Republicans in the House of Representatives should send a “clean” bill to the Senate. Anything less than a blank check is not considered a “clean” bill. The Constitution gives the House of Representatives the responsibility to originate all spending bills based on what they think should and should not be funded. But the word “clean” is now apparently supposed to override the Constitution.

If Republicans want to show some seriousness about articulating their case, they might start by deleting the abbreviation “CR” from their vocabulary. As has been said, “the journey of a thousand miles begins with a single step.” That journey is long overdue.

Obama’s Notion of “Settled” Law

The Obamacare/shutdown battle has spawned myriad myths. The most egregious concern the substance of the fight, the identity of the perpetrators, and the origins of the current eruption.

(1) Substance

President Obama indignantly insists that GOP attempts to abolish or amend Obamacare are unseemly because it is “settled” law, having passed both houses of Congress, obtained his signature, and passed muster with the Supreme Court.

Yes, settledness makes for a strong argument — except from a president whose administration has unilaterally changed Obamacare five times after its passage, including, most brazenly, a year-long suspension of the employer mandate.

Article 1 of the Constitution grants the legislative power entirely to Congress. Under what constitutional principle has Obama unilaterally amended the law? Yet when the House of Representatives undertakes a constitutionally correct, i.e., legislative, procedure for suspending the other mandate — the individual mandate — this is portrayed as some extra-constitutional sabotage of the rule of law. Why is tying that amendment to a generalized spending bill an outrage, while unilateral amendment by the executive (with a Valerie Jarrett blog item for spin) is perfectly fine?

(2) Perpetrators

The mainstream media have been fairly unanimous in blaming the government shutdown on the GOP. Accordingly, House Republicans presented three bills to restore funding to national parks, veterans, and the District of Columbia government. Democrats voted down all three. (For procedural reasons, the measures required a two-thirds majority.)

Senate Majority Leader Harry Reid won’t even consider these refunding measures. And the White House has promised a presidential veto.

The reason is obvious: to prolong the pain and thus add to the political advantage gained from a shutdown blamed on the GOP. They are confident the media will do a “GOP makes little Johnny weep at the closed gates of Yellowstone, film at 11” despite Republicans having just offered legislation to open them.

(3) Origins

The most ubiquitous conventional wisdom is that the ultimate cause of these troubles is out-of-control tea-party anarchists.

But is this really where the causal chain ends? The Tea Party was created by Obama’s first-term overreach, most specifically Obamacare. This frantic fight against the law today is the fruits of the way it was originally enacted.

From Social Security to civil rights to Medicaid to Medicare, never in the modern history of the country has major social legislation been enacted on a straight party-line vote. Never. In every case, there was significant reaching across the aisle, enhancing the law’s legitimacy and endurance. Yet Obamacare — which revolutionizes one-sixth of the economy, regulates every aspect of medical practice, and intimately affects just about every citizen — passed without a single GOP vote.

The Democrats insist they welcomed contributing ideas from Republicans. Rubbish. Republicans proposed that insurance be purchasable across state lines. They got nothing. They sought serious tort reform. They got nothing. Why? Because, admitted Howard Dean, Democrats didn’t want to offend the trial lawyers.

Moreover, the administration was clearly warned. Republican Scott Brown ran in the most inhospitable of states, Massachusetts, on the explicit promise to cast the deciding vote blocking Obamacare. It was January 2010, the height of the debate. He won. Reid ignored this unmistakable message of popular opposition and conjured a parliamentary maneuver — reconciliation — to get around Brown.

Nothing illegal about that. Nothing illegal about ramming it through without a single opposition vote. Just totally contrary to the modern American tradition — and the constitutional decency — of undertaking major social revolutions only with bipartisan majorities. Having stuffed Obamacare down the throats of the GOP and the country, Democrats are now paying the price.

I don’t agree with current Republican tactics. I thought the defunding demand impossible and, therefore, foolish. I thought that if, nonetheless, they insisted on making a stand, it should not be on shutting down the government, which voters oppose five to one, but on the debt ceiling, which Americans favor two to one as a vehicle for restraining government.

Tactics are one thing, but substance is another. It’s the Democrats who have mocked the very notion of settled law. It’s the Democrats who voted down the reopening of substantial parts of the government. It’s the Democrats who gave life to a spontaneous, authentic, small-government opposition – a.k.a the Tea Party — with their unilateral imposition of a transformational agenda during the brief interval when they held a monopoly of power.

That interval is over. The current unrest is the residue of that hubris.

Obama’s Punitive Liberalism

Way back in January, when it emerged that Beyoncé had treated us to the first ever lip-synched national anthem at a presidential inauguration, I suggested in this space that this strange pseudo-performance embodied the decay of America’s political institutions from the real thing into mere simulacrum. But that applies to government “crises,” too — such as the Obamacare “rollout,” the debt “ceiling,” and the federal “shutdown,” to name only the three current railroad tracks to which the virtuous damsel of Big Government has been simultaneously tied by evil mustache-twirling Republicans.

This week’s “shutdown” of government, for example, suffers (at least for those of us curious to see it reduced to Somali levels) from the awkward fact that the overwhelming majority of the government is not shut down at all. Indeed, much of it cannot be shut down. Which is the real problem facing America. “Mandatory spending” (Social Security, Medicare, et al.) is authorized in perpetuity — or, at any rate, until total societal collapse. If you throw in the interest payments on the debt, that means two-thirds of the federal budget is beyond the control of Congress’s so-called federal budget process. That’s why you’re reading government “shutdown” stories about the PandaCam at the Washington Zoo and the First Lady’s ghost-Tweeters being furloughed.

Nevertheless, just because it’s a phony crisis doesn’t mean it can’t be made even phonier. The perfect symbol of the shutdown-simulacrum so far has been the World War II Memorial. This is an open-air facility on the National Mall — that’s to say, an area of grass with a monument at the center. By comparison with, say, the IRS, the National Parks Service is not usually one of the more controversial government agencies. But, come “shutdown,” they’re reborn as the shock troops of the punitive bureaucracy. Thus, they decided to close down an unfenced open-air site — which oddly enough requires more personnel to shut than it would to keep it open.

So the Parks Service dispatched their own vast army to the World War II Memorial to ring it with barricades and yellow “Police Line — Do Not Cross” tape strung out like the world’s longest “We Support Our Troops” ribbon. For good measure, they issued a warning that anybody crossing the yellow line would be liable to arrest — or presumably, in extreme circumstances, the same multi-bullet ventilation that that mentally ill woman from Connecticut wound up getting from the coppers. In a heartening sign that the American spirit is not entirely dead, at least among a small percentage of nonagenarians, a visiting party of veterans pushed through the barricades and went to honor their fallen comrades, mordantly noting for reporters that, after all, when they’d shown up on the beach at Normandy it too had not been officially open.

One would not be altogether surprised to find the feds stringing yellow police tape along the Rio Grande, the 49th parallel, and the Atlantic and Pacific coasts, if only to keep Americans in rather than anybody else out. Still, I would like to have been privy to the high-level discussions at which the government took the decision to install its Barrycades on open parkland. For anyone with a modicum of self-respect, it’s difficult to imagine how even the twerpiest of twerp bureaucrats would consent to stand at a crowd barrier and tell a group of elderly soldiers who’ve flown in from across the country that they’re forbidden to walk across a piece of grass and pay their respects. Yet, if any National Parks Service employee retained enough sense of his own humanity to balk at these instructions or other spiteful, petty closures of semi-wilderness fishing holes and the like, we’ve yet to hear about it.

The World War II Memorial exists thanks to some $200 million in private donations — plus $15 million or so from Washington: In other words, the feds paid for the grass. But the thug usurpers of the bureaucracy want to send a message: In today’s America, everything is the gift of the government, and exists only at the government’s pleasure, whether it’s your health insurance, your religious liberty, or the monument to your fallen comrades. The Barrycades are such a perfect embodiment of what James Piereson calls “punitive liberalism” they should be tied round Obama’s neck forever, in the way that “ketchup is a vegetable” got hung around Reagan-era Republicans. Alas, the court eunuchs of the Obama media cannot rouse themselves even on behalf of the nation’s elderly warriors.

Meanwhile, Republicans offered a bill to prevent the shutdown affecting experimental cancer trials for children. The Democrats rejected it. “But if you can help one child who has cancer,” CNN’s Dana Bash asked Harry Reid, “why wouldn’t you do it?”

“Why would we want to do that?” replied the Senate majority leader, denouncing Miss Bash’s question as “irresponsible.” For Democrats, the budget is all or nothing. Republican bills to fund this or that individual program have to be rejected out of hand as an affront to the apparent constitutional inviolability of the “continuing resolution.” In fact, government by “continuing resolution” is a sleazy racket: The legislative branch is supposed to legislate. Instead, they’re presented with a yea-or-nay vote on a single all-or-nothing multi-trillion-dollar band-aid stitched together behind closed doors to hold the federal leviathan together while it belches its way through to the next budget cycle. As Professor Angelo Codevilla of Boston University put it, “This turns democracy into a choice between tyranny and anarchy.” It’s certainly a perversion of responsible government: Congress has less say over specific federal expenditures than the citizens of my New Hampshire backwater do at Town Meeting over the budget for a new fence at the town dump. Pace Senator Reid, Republican proposals to allocate spending through targeted, mere multi-billion-dollar appropriations are not only not “irresponsible” but, in fact, a vast improvement over the “continuing resolution”: To modify Lord Acton, power corrupts, but continuing power corrupts continually.

America has no budget process. That’s why it’s the brokest nation in history. So a budgeting process that can’t control the budget in a legislature that can’t legislate leads to a government shutdown that shuts down open areas of grassland and the unmanned boat launch on the Bighorn River in Montana. Up next: the debt-ceiling showdown, in which we argue over everything except the debt. The conventional wisdom of the U.S. media is that Republicans are being grossly irresponsible not just to wave through another couple trillion or so on Washington’s overdraft facility. Really? Other countries are actually reducing debt: New Zealand, for example, has a real budget that diminishes net debt from 26 percent of GDP to 17 percent by 2020. By comparison, America’s net debt is currently about 88 percent, and we’re debating only whether to increase it automatically or with a few ineffectual strings attached.

My favorite book of the moment is The Liberty Amendments, the new bestseller by Mark Levin — not because I agree with all his proposed constitutional amendments, and certainly not because I think they represent the views of a majority of Americans, but because he’s fighting on the right battleground. A century of remorseless expansion by the “federal” government has tortured the constitutional order beyond meaning. America was never intended to be an homogenized one-size-fits-all nation of 300 million people run by a government as centralized as France’s. It’s no surprise that when it tries to be one it doesn’t work terribly well.
